EEO-1 Reporting to Open in April 2021
After delaying the opening of the 2019 EEO-1 Component 1 Data Collection on May 8, 2020 in light of the COVID-19 public health emergency, the EEOC has announced the 2019 as well as 2020 EEO-1 Component 1 Data Collection is now on schedule to open in April 2021. Exact filing dates have not yet been announced, however EEOC has notified filers to begin preparing their data now so as to not be caught off guard. All employers with 100 or more employees and federal contractors meeting certain thresholds will be required to file. Note that employers with less than 100 employees who are owned or affiliated with another entity such that the combined employee count is over 100 employees may also be required to file this report.
Component 1 filers will be mailed and emailed important information about the new EEO-1 Online Filing System in April 2021. The letters and emails will include critical information on the opening of the 2019/2020 EEO-1 Component 1 Data Collection. It will also include information on how to register, submit and certify 2019/2020 EEO-1 data through the new EEO-1 Online Filing System.
EEOC has made clear this will be the Component 1 report, and therefore no pay data will be required for this filing. However, the burden on filers will be higher than in years past as they will be required to file data for both 2019 and 2020. Covered employers should act now to ensure that all employees have had the opportunity to voluntarily self-identify their gender, ethnicity and race. While I-9's and visual observation may be helpful to fill gaps, employers should re-extend the invitation to voluntarily self-id as this is the preferred method.
